1. Description of the Services

Our Services allow you to upload a photo of a bug, insect, or spider and receive an AI-generated identification, including a common name, scientific name, and a general danger or safety classification. The Services are provided free of charge and do not require account creation.

2. Accuracy Disclaimer — Please Read Carefully

Our identification results are generated by an AI model and reviewed periodically by qualified reviewers, but individual results are not manually verified in real time and are not guaranteed to be accurate. Species identification from a photo has inherent limitations, including image quality, unusual coloring, juvenile or damaged specimens, and visual similarity between species.

You should not rely solely on our identification results to make safety decisions, including decisions about handling an insect or spider, entering an area, or seeking medical care. If you believe you have been bitten or stung and are experiencing a medical emergency, contact emergency services immediately rather than relying on this tool. See our separate Medical Disclaimer for more detail.

3. Acceptable Use

When using the Services, you agree not to:

• Upload photos that are unlawful, harmful, obscene, or that infringe another person's rights
• Upload images of people, in a manner intended to identify or profile a specific individual
• Attempt to interfere with, disrupt, or gain unauthorized access to our systems
• Use automated systems, bots, or scrapers to access the Services at a scale beyond normal individual use, without our prior written permission
• Use the Services in any way that violates applicable local, national, or international law
• Misrepresent identification results as professional pest control, medical, or entomological advice

4. Your Content and License to Us

When you upload a photo, you retain ownership of that image. By uploading it, you grant us a limited, non-exclusive, royalty-free license to process the image solely for the purpose of returning an identification result to you, and, only if you have separately opted in, to use an anonymized version of the image to improve our identification model. This license ends when the image is deleted from our servers as described in our Privacy Policy.

You confirm that you have the right to upload any photo you submit and that doing so does not infringe any third party's rights.

5. Intellectual Property

All content on this site other than photos you upload, including text, graphics, logos, the identification database, and the underlying software, is owned by ScanaBug or its licensors and is protected by copyright and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written permission, except for personal, non-commercial use.

6. Third-Party Links and Services

Our Services may link to third-party websites, including pest control resources, medical information sources, or affiliate partners. We do not control and are not responsible for the content, accuracy, or practices of third-party sites. Any purchase or engagement with a third party is solely between you and that party.

7. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that identification results will be accurate or complete.

8. Limitation of Liability

To the fullest extent permitted by law, ScanaBug and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from or related to your use of the Services, including any damages resulting from reliance on an identification result, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from these Terms or the Services will not exceed $100 USD, given that the Services are provided free of charge.

9. Indemnification

You agree to indemnify and hold harmless ScanaBug from any claims, damages, losses, or expenses, including reasonable legal fees, arising from your violation of these Terms or your misuse of the Services.

10. Termination

We reserve the right to suspend or restrict access to the Services, for any user or category of users, at our discretion, including in cases of suspected abuse, without prior notice.

11. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date above reflects the most recent revision. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of law principles. Any disputes arising from these Terms or the Services will be subject to the exclusive jurisdiction of the courts located in Delaware, USA.
